§ 1 Description of services and advertising
With the Wantedbook services, Wantedbook provides an online service with which the user, as a provider, can create and publish "advertisements" consisting of text and images, and as a customer, can view advertisements published by other users. In addition, Wantedbook services also allow the exchange of electronic messages between the provider and the customer. To the extent necessary for conversion into file formats suitable for the Wantedbook services, Wantedbook converts the user's advertisements into formats suitable for use in mobile applications and on websites.
Wantedbook services are intended to publish advertisements and connect sellers and buyers of the goods and services listed. Wantedbook itself is not a supplier of the products advertised in the advertisements.
As part of the ad display and on the user overview page, Wantedbook displays additional information about the user and their activities in the Wantedbook services (this may include, for example, information about the response rate and/or average response time to queries on published ads, so-called activity indicators). Wantedbook can also identify the user based on certain criteria.
Wantedbook allows users to publicly rate each other based on specific interactions. Use of the rating system is governed by Wantedbook's rating policy .
Wantedbook allows users to follow other users or listings, and save searches. Wantedbook keeps users informed about items in their watchlist, including changes in description or price, new items listed for sale by subscribers, and new items matching their search.
Wantedbook publishes and promotes the Wantedbook services and the advertising placed by users themselves and through third parties, for example by including advertising or parts of it on websites, in software applications (“apps”), in emails, in print, radio and television marketing campaigns or in other media. Wantedbook also allows third parties to advertise their offers and services through the Wantedbook services. In order to support these activities, Wantedbook may also provide third parties with access to data, information and content published through the Wantedbook services. The user grants Wantedbook the above-mentioned use of its advertising for the purpose of promoting and increasing the reach of the Wantedbook services. This also applies to translations for the purpose of integrating translated advertising into foreign language offers.
Wantedbook customer support is available to all users free of charge for filing complaints and other inquiries. For this purpose, Wantedbook also uses an internal complaint management system for business users. Customer support documents submitted complaints, reviews them carefully and takes all necessary actions within a reasonable time. It informs the user about the complaint and the outcome of the complaint process.
Wantedbook allows users to sort their search results by various criteria (e.g. publication date, price). In addition, the search results also display ads for which the respective advertiser has agreed to pay an additional fee for their prominent display (e.g. as a top ad). More information about the possible options for prominent display in the display of ads can be found here .
§ 2 Registration, user account
In order to fully utilize Wantedbook's services, including posting advertisements, providing contact information for a specific advertiser, and exchanging emails with other users, users must register with Wantedbook. Registration is required if the user is an individual, a legal entity, or a partnership.
The user is obliged to provide the data collected during registration on Wantedbook truthfully and completely. If the data changes after registration, the user is obliged to immediately update the data in the password-protected user area of Wantedbook services.
By submitting the registration form, the user submits an offer to enter into a user agreement with Wantedbook, thereby accepting the terms of use and declaring that they have read the privacy policy. If Wantedbook accepts the registration, the user receives a confirmation email with a personalized link. Upon receipt of the confirmation email, an agreement for the use of Wantedbook services is concluded between Wantedbook and the user, hereinafter referred to as the "User Agreement". To complete the registration, the user must click on the link provided in the confirmation email to confirm their email address. The right to conclude a user agreement is not provided.
Upon successful registration, an account is created for the user, which can be accessed using their email address and other available login options. The password can be changed by the user at any time through the password-protected user area. It must be kept secret by the user and protected from access by unauthorized third parties. If the user discovers or suspects that their access data is being used without permission by a third party, they must immediately notify Wantedbook and change their password immediately.
Each user may register for Wantedbook Services only once, for personal use and for commercial or freelance use (“commercial users”). User accounts are not transferable.
Wantedbook may make the use of certain features of the Wantedbook Services or the scope of use of individual features contingent on the fulfillment of additional requirements, such as the provision of additional data, verification and confirmation of user data, duration of use, type of use (private/commercial), user's previous payment history and/or provision of certain evidence.
Wantedbook also reserves the right to test new or modified features and functionality limited to certain user groups in order to improve the user experience, provided that this is reasonable for users, taking into account Wantedbook's legitimate interests. This may result in different displays for different users.
The user receives an overview of the advertisements they have published on their profile page. They also receive information about their activity indicators and can make changes to their settings, preferences and data.
As part of the Wantedbook services, Wantedbook has access to various information about users, including personal data. This includes, in particular, information that users transmit to Wantedbook as part of the Wantedbook services (e.g. contact or listing information), as well as information obtained in the course of providing and processing the Wantedbook services (e.g. reviews, activity indicators or messages). Users receive information via the Wantedbook service that is necessary for the provision of the Wantedbook service (in particular messages and contact information of the interested buyer). Users have access to important information that they have sent in the "Settings" section.
Wantedbook provides certain groups of users with analytics data about their activities and the ads they post. Wantedbook will share ads, including user information contained therein, and other information from the Wantedbook services with third parties or allow third parties to access this information if this is necessary to provide the Wantedbook service (e.g. to increase reach in the case of Wantedbook advertising and posting of ads through third parties) or if Wantedbook has a legal or contractual right to do so.
Information on the processing of personal data by Wantedbook, including transfer to third parties and the rights of the user as a data subject, is provided in its privacy policy.
§ 3 Conclusion of contracts for advertising and service packages
After successful registration on Wantedbook, the user is able to create their own ads for free using Wantedbook services and publish them on Wantedbook services. Wantedbook reserves the right to publish ads in certain categories only for a fee. Regardless of this, Wantedbook reserves the right to limit the number of ads published by the user for free during a certain period of time and to offer the publication of additional ads only for a fee. The user has the opportunity to select and book certain additional paid services when posting an ad or, if necessary, to book such additional paid services even after the ad has been published. Wantedbook may offer service packages with special services or conditions for certain user groups and/or in certain categories.
By entering the advert data, selecting additional paid services (if applicable) or the desired service package and submitting the relevant form, the user sends Wantedbook a binding offer to enter into an agreement for the temporary publication of an advert, hereinafter referred to as the "Advertisement Agreement", or a service package, hereinafter referred to as the " Service Package Agreement ", on the Wantedbook services, for which additional terms and conditions may apply. The process can be cancelled at any time before submitting the form by closing the browser window or the application.
Wantedbook may accept an offer to conclude an advertising contract by making a separate statement to the user or by activating the ad. After the acceptance of the Wantedbook offer, an advertising contract or a service package contract is concluded. Wantedbook is not obliged to accept contractual offers from the user.
The advertising data is stored electronically. The user can manage their advertisements in the password-protected user area of the Wantedbook services, including deleting them there. The text of the advertising contract or service package agreement is not stored separately. However, the user can access the terms of use underlying the advertising contract or service package agreement at any time via the Wantedbook website and subsequently save them in a reproducible format.
Even after concluding an agreement for advertising placement, for technical reasons it is possible that the advertisement will not be found immediately after activation through a search by category or using search queries in Wantedbook services.
If an invoice is sent, it will be done exclusively electronically.
The user is not allowed to offer or transfer the purchased services to third parties without the consent of Wantedbook; this applies in particular to services from the service package agreement.
§ 4 Requirements for advertising content
The user is obliged to place each ad in the appropriate category and to truthfully describe the respective offer, indicating all relevant characteristics and features in words and, if possible, with meaningful images. Wantedbook may support the user, for example, by suggesting a category or additional characteristics for the advertised product based on the given title. The user is obliged to carefully review all entries and accept only relevant suggestions for his ad.
When posting an ad, the user is also required to indicate whether he/she is posting the ad for personal purposes or for the purpose of carrying out commercial or individual professional activities. Wantedbook may, under certain conditions, require the user to indicate in general whether he/she is using his/her account for purely personal or purely commercial purposes.
It is prohibited to post advertisements, text, images or other content that violates the provisions of the law, these Terms of Use, the rights of third parties or generally accepted standards of decency. In particular, posting content that violates copyright, trademarks and competition laws or provisions of legislation on the protection of minors, violates Wantedbook's policy on prohibited content or contains false information or is otherwise misleading.
Users who use Wantedbook services as commercial suppliers or for other business purposes are subject to special legal provisions. Among other things, they are obliged to comply with statutory information obligations, including, in particular, the provision of a full identification of the supplier that meets legal requirements. Wantedbook does not accept any liability for the accuracy and completeness of the information contained therein.
§ 5 Special obligations of the user
The User shall refrain from any actions that may jeopardize the safe operation of the Wantedbook Services or harass other users, or that otherwise go beyond the intended use of the Wantedbook Services. In particular, the User shall refrain from: - sending advertising emails, advertising SMS messages, chain letters or other harassing content; - sending viruses or other technologies that may harm the Wantedbook Services or the interests or property of other users; - creating an excessive load on the infrastructure of the Wantedbook Services or otherwise disrupting or threatening the functioning of the Wantedbook Services; - copying, making available to the public, distributing, editing or otherwise using Wantedbook content in a manner beyond the intended use of the Wantedbook Services without the prior consent of Wantedbook. - reproducing, making available to the public, distributing, editing or otherwise using advertising or other content of third parties without their prior consent in a manner beyond the intended use of the Wantedbook Services. - use crawlers, spiders, scrapers or other automated mechanisms to access Wantedbook services and collect content without the express written consent of Wantedbook. - collect or use information, such as email addresses or telephone numbers, about other users without the prior consent of the users. - bypass measures designed to prevent or restrict access to Wantedbook services.
The User is obliged to save and archive all data and information stored in the Wantedbook services that he currently or in the future needs or may need for the purposes of preserving evidence, accounting or other purposes, on his own data carrier.
§ 6 Removal of advertising, blocking of users, other measures
Wantedbook reserves the right to remove, in whole or in part, any advertisements or other user content posted on the Wantedbook services, or to delay or refuse to publish advertisements or other user content if there are specific indications that the advertisement or content violates these Terms of Use or legal requirements, or that the user has otherwise culpably violated contractual obligations. In such a case, Wantedbook may also issue a warning to the user and/or temporarily or permanently exclude the user from using the Wantedbook services. In the event of a temporary or permanent ban, Wantedbook will notify the user of this circumstance 30 days before the ban comes into effect and provide the reasons for the ban on a durable medium (e.g. by e-mail), unless there are compelling reasons to the contrary. The above period does not apply if the termination or permanent blocking is due to mandatory legal provisions or an official order, or if Wantedbook can prove that the user has repeatedly violated these Terms of Use, which has led to the termination or permanent blocking.
Wantedbook also reserves the right not to publish or to remove from Wantedbook services any advertisements that contain indications that the advertised product is not freely available for sale or is otherwise offered illegally, or if there is an indication that the advertisement has been or will be posted for offensive purposes. Wantedbook also reserves the right to exclude certain products from advertising and to remove the relevant advertisements if these products are commonly advertised for offensive purposes.
If a user has been excluded from using the Wantedbook Services by Wantedbook or if the user's user agreement has been terminated, the user may no longer use the Wantedbook Services with other user accounts, including user accounts created for third parties, and may not re-register to use the Wantedbook Services.
Wantedbook has the right to limit or terminate the provision of Wantedbook services in whole or in part, as well as to delay the publication of advertisements or other user content, if this is necessary due to limitations in the capacity, security or integrity of the servers or for the implementation of technical measures, or if this serves the proper or improved provision of services (technical work).
If Wantedbook takes one of the measures under this Section 6, in particular in the event of a restriction, blocking or termination under Section 10 No. 2, users have the opportunity to clarify the facts underlying such measures within the framework of Wantedbook's internal customer support complaint management procedure (see Section 1 No. 7 of these Terms of Use).
§ 7 Fees
Wantedbook charges fees for certain services provided in connection with the Wantedbook Services and for the use of certain features of the Wantedbook Services. Wantedbook will clearly inform the user of the fees and the amount of the fees before booking any paid service.
The prices quoted by Wantedbook for the provision of its own services within the Wantedbook services are stated in euros and include the statutory VAT.
The agreed fees are due and payable immediately and can be paid using the payment methods accepted by Wantedbook. If Wantedbook offers and accepts direct debit via SEPA direct debit as a payment method, the direct debit collection ("pre-notification") will be announced with a notice period of at least five working days; the SEPA pre-notification period will be reduced accordingly to five days. If the collection fails despite timely notification and the user is responsible for the failure, the user must reimburse Wantedbook for the additional costs incurred.
§ 8 Liability of Wantedbook
Advertisements and other user content published on Wantedbook services do not reflect the opinion of Wantedbook and are not checked by Wantedbook for their legality, accuracy or completeness. Wantedbook is not responsible for the accuracy or completeness of the information contained in advertisements, and does not guarantee the quality, safety or legality of goods or services offered by users.
Wantedbook is liable in accordance with the statutory provisions for intent and gross negligence on the part of Wantedbook, its legal representatives, executives or other vicarious agents. The same applies to the assumption of guarantees or any other assumption of strict liability, as well as to claims under the Product Liability Act or in the event of culpable injury to life, body or health. Wantedbook is also liable in principle for simple negligent violations of essential contractual obligations caused by Wantedbook, its representatives, executives and other vicarious agents, i.e. those obligations on the fulfillment of which the user regularly relies and can rely for the proper execution of the contract. However, in this case, the amount is limited to the typically occurring, foreseeable damage. Any further liability of Wantedbook is excluded.
To the extent that Wantedbook's liability is excluded or limited, this also applies to the personal liability of its legal representatives, managers and other vicarious agents.
§ 9 User's liability
The user releases Wantedbook from liability for all claims brought against Wantedbook by other users or other third parties in connection with the infringement of their rights by advertising and other content posted by the user on the Wantedbook services, or in connection with the user's other use of the Wantedbook services. The user assumes Wantedbook's costs for legal defense, including all legal costs and attorneys' fees, to the extent permitted by law. There is no right to compensation for damages if the user is not responsible for the violation.
In the event of a claim being made by a third party, the user is obliged to provide Wantedbook, upon request, with all information necessary for the defense, truthfully and in full, necessary for the consideration of the claims and the defense against them.
Any liability of the user that goes beyond these provisions shall remain unaffected.
§ 10 Termination of the User Agreement
Unless otherwise agreed, e.g. within the scope of a service package, the user can terminate the user agreement at any time without written notice. To do so, simply send a notice of termination by e-mail to or by post to Wantedbook UG (limited liability company), Am Brunnhölzl 17, 84106 Volkenschwand. In the event of termination during an ongoing subscription to a paid additional service, there is no right to a (proportional) refund.
Wantedbook may terminate the user agreement at any time with 30 days' notice. If an agreement for a paid additional service with a specific term has been concluded between the user and Wantedbook and the agreed term does not end until after the time specified in sentence 1, termination by Wantedbook is only possible with 30 days' notice before the end of the agreed term of the additional service. For commercial users, Wantedbook will provide the reasons for termination on a durable medium (e.g. by e-mail), whereby the reasons may arise, among other things, from Section 6 No. 1 and 2 of these Terms of Use. The user may no longer book new services from Wantedbook after receiving the notice of termination announced by Wantedbook. This notice period does not apply if the termination is due to mandatory legal provisions or an official order. Wantedbook will provide the user with separate reasons for this, unless there are compelling reasons to the contrary. Wantedbook's right to remove individual advertisements, block users and take other measures in accordance with Section 6, as well as the right to terminate the agreement without notice for good cause, remain unaffected.
Upon termination of the user agreement, all current advertisements of the user will be deleted from the Wantedbook services and the user account will be deactivated. From this point on, the user will no longer have access to the user account. The user account and all data stored in it will be deleted no later than six months after termination of the agreement. This does not apply to data that Wantedbook is required to store by law or has a legitimate interest in storing, such as to prevent re-registration after a legal block. Aggregated data resulting from use may in principle continue to be stored even after termination of the agreement.
Wantedbook also reserves the right to permanently deactivate and delete user accounts with incomplete registration data and user accounts that have been inactive for at least 12 months. Wantedbook will notify the user accordingly on a durable medium (e.g. by email) at least 30 days before deleting the user account.
§ 11 Data protection
Detailed information on the collection, processing and use of user personal data in connection with registration, implementation of the user agreement and use of Wantedbook services can be found in the Privacy Policy. from Wantedbook.
§ 12 Changes to the Terms of Use
The following applies to changes to these Terms of Use: The user may, on the one hand, agree to the changed Terms of Use by posting an advertisement or requesting information about it; Wantedbook will then expressly indicate this in a corresponding notice. On the other hand, Wantedbook may propose changes to these Terms of Use to the user at any time. Changes to these Terms of Use will be proposed to users in text form (e.g. by e-mail) at least 30 days before the intended effective date. The user's consent is deemed to be given unless his refusal is communicated to Wantedbook in text form before the intended effective date of the changes. If the user does not agree to the changes, he has the right to terminate the contract without notice and free of charge before the intended effective date of the changes. In the message proposing the changes, Wantedbook will also expressly inform the user of his right of refusal, the deadline for doing so and the possibility of termination. The amended Terms of Use will also be published on the Wantedbook website.
§ 13 Exercise of rights by third parties, transfer of contract
For the purpose of executing the agreement and exercising the rights arising from this agreement, Wantedbook may use other affiliated companies.
Wantedbook reserves the right to transfer its rights and obligations arising from this contractual relationship, in whole or in part, to a third party with four weeks' notice. In this case, the participant has the right to terminate the user agreement.
§ 14 Final Provisions
The Terms of Use, the User Agreement and all agreements based thereon between Wantedbook and the user are governed exclusively by the laws of the Federal Republic of Germany. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded. If the user is a consumer, the mandatory consumer protection provisions of the user's country of residence also apply, provided that they provide the user with greater protection.
If the user is a merchant within the meaning of the German Commercial Code (HGB), a special fund under public law or a legal entity under public law, Kelheim is the exclusive place of jurisdiction for all disputes arising from the user agreement and agreements based on it. The same applies if the participant changes his place of residence abroad after conclusion of the contract or does not have a general place of jurisdiction in Germany. For users who are consumers, the place of jurisdiction is the respective place of residence of the user. For all disputes arising from the user agreement and these Terms of Use, Kelheim is the additional place of jurisdiction for consumers.
Wantedbook is neither willing nor obliged to participate in consumer dispute resolution procedures before a consumer arbitration board (Article 36 (1) No. 1 VSBG).
Wantedbook always strives to resolve any disputes out of court.
If individual provisions of these Terms of Use are or become invalid or ineffective in whole or in part, this shall not affect the validity of the remaining provisions. Any provisions not included or invalid in these Terms of Use shall be replaced by a regulatory act. If such a regulatory act is missing in the relevant case (gap) or would lead to an unacceptable result, the parties shall enter into negotiations to replace the invalid or ineffective provision with a valid provision that comes as close as possible to its economic purpose.
